Terms of Service

1. Acceptance of terms

By accessing or using the MENAHIRE platform ("Platform"), operated by MENAHIRE ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all users of the Platform, including Organizations, Independent Recruiters, team members, and Applicants (job seekers).

2. Definitions

• "Organization" — a company, team, or entity that registers on the Platform to manage recruitment.
• "Independent Recruiter" — an individual recruiter using the Platform independently.
• "Applicant" — a job seeker who submits applications through the Platform or a connected careers page.
• "User" — any individual accessing the Platform (Organization members, recruiters, or applicants).
• "Content" — any data, text, files, or materials uploaded to or generated on the Platform.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of an Organization, you represent that you have authority to bind that Organization to these Terms.

4. Account registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use at support@menahire.com.

5. Permitted use

The Platform is provided for legitimate recruitment purposes. You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload false, misleading, or fraudulent job postings or candidate information.
• Attempt to gain unauthorized access to any part of the Platform or its systems.
• Interfere with or disrupt the Platform's infrastructure, security, or performance.
• Scrape, crawl, or harvest data from the Platform using automated tools without our written consent.
• Use applicant data for purposes unrelated to the specific job application, unless explicit consent is obtained.
• Resell, sublicense, or redistribute access to the Platform without our prior written approval.
• Upload content that is discriminatory, harassing, defamatory, or otherwise objectionable.

6. Plans, billing, and payments

MENAHIRE offers Free, Premium, and Enterprise plans. Pricing details are available on our website and within the Platform.

• Free Plan: limited features at no cost, subject to usage limits.
• Premium Plan: paid subscription with enhanced features. Billed monthly or annually as selected.
• Enterprise Plan: custom pricing and features for larger organizations. Contact sales for details.

All paid subscriptions are billed in advance. You authorize us (or our payment processor) to charge the applicable fees. Prices are in the currency displayed at checkout and exclude applicable taxes unless stated otherwise.

Cancellation and refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• No prorated refunds are provided for the remainder of a billing period after cancellation.
• We reserve the right to change pricing with 30 days' advance notice.

Free trials

If a free trial is offered, you will not be charged until the trial period ends. If you do not cancel before the trial expires, your subscription will automatically convert to a paid plan.

7. Data and content ownership

• Your Content: you retain ownership of all Content you upload to the Platform. By uploading Content, you grant us a limited license to host, process, and display it as necessary to provide the service.
• Applicant data: Organizations and Recruiters are responsible for ensuring they have a lawful basis to collect, process, and use applicant data uploaded to the Platform.
• Our Platform: MENAHIRE and its underlying technology, design, and branding are owned by us and protected by intellectual property laws. Nothing in these Terms grants you rights to our intellectual property except as needed to use the Platform.

8. AI-powered features

The Platform includes AI-assisted features such as CV parsing, candidate matching, and scoring. These features are designed to assist human decision-makers and do not make autonomous hiring decisions.

• AI outputs are recommendations only. Hiring decisions remain the sole responsibility of the Organization or Recruiter.
• We do not guarantee the accuracy of AI-generated scores, summaries, or recommendations.
• You agree to review AI outputs before making employment decisions and not rely solely on automated analysis.

9. Third-party integrations

The Platform may integrate with third-party services (e.g., Gmail, Google OAuth, payment processors). Use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for third-party services or their availability.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

11. Service availability

We strive to maintain the Platform's availability but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, and we will endeavor to provide advance notice of any significant downtime.

12. Limitation of liability

To the maximum extent permitted by applicable law:

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claims arising from the use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for hiring decisions made by Organizations or Recruiters using the Platform.

13. Indemnification

You agree to indemnify and hold harmless MENAHIRE, its affiliates, and their officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your violation of these Terms.
• Your use of the Platform.
• Content you upload or share through the Platform.
• Your violation of any third-party rights or applicable laws.

14. Termination

• You may close your account at any time by contacting us or through in-product settings.
• We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.
• Upon termination, your right to use the Platform ceases immediately. We will retain data as described in our Privacy Policy.
• You may request export of your data before account closure.

15. Governing law and disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the use of the Platform shall be resolved through good-faith negotiation first. If unresolved, disputes may be submitted to binding arbitration or the competent courts of the applicable jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

17. Miscellaneous

• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and MENAHIRE regarding the Platform.
• Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• No waiver: our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations at any time.
